Findings: Alleged Victim (AV) had a known history of misuse of medications leading to an accidental overdose. On or about June 18, 2020, AV approached staff and stated that he/she saved his/her medications for several days, and had ingested all of them at one. AV was transported to the hospital and admitted for the night for monitoring. Prior to AV using the medication inappropriately, facility management was notified of AV being bullied by other residents and AV making self-harm statements. The facility failed to respond appropriately to AV being bullied by other residents, and the subsequent emotional distress experienced by AV, the facility also failed to appropriately plan care for AV's known behavior of unsafe medication ingestion, which is a violation of resident rights, is neglect of care and constitutes abuse.
