Findings: Alleged Victim (AV) relied on the facility to meet his/her basic care needs and is a high fall risk. AV was given a back brace at the hospital with instructions to keep the brace on except when bathing. The facility updated AV's care plan to include AV should be encouraged to wear his/her back brace as tolerated, that AV needs to be in his/her wheelchair to ambulate as much as possible, and that he/she should be checked on frequently. Per facility documentation AV took his/her back brace off regularly. The facility failed to provide sufficient documentation to indicate AV was encouraged to wear his/her back brace, putting AV at risk for serious harm, which is a violation of resident rights, is neglect of care and constitutes abuse.
