Findings: On or about September 24, 2020, Witness 1 (W1) inappropriately touched Alleged Victim (AV) in a sexual manner when W1 and AV were walking in the yards of their respective homes at the facility and W1 called AV over to the gate, reached over the gate, and put his/her hands down AV's shirt. W1 has a history of inappropriately touching people of the opposite gender. An investigation determined that facility staff were not in the yard with residents when the incident began but entered into the yard while the incident was in progress. The facility failed to provide a safe environment for AV which is a violation of resident rights, is considered neglect of care and constitutes abuse.
