Findings
On or about December 27, 2020, Alleged Perpetrator #2 (AP2) failed to use caution while pushing the Alleged Victim (AV) in his/her wheelchair. AP2 was pushing AV too fast after he/she noticed that AV was not sitting correctly in his/her chair. AV caught his/her feet on the carpet and fell from the wheelchair. AP2 moved AV to his/her bed and did not notify other staff of the fall, nor did AP2 call emergency services when he/she knew that AV was in pain. That evening, staff learned of AV being in pain and called emergency services. AV was sent to the hospital and diagnosed with a broken hip requiring surgery. AP2's actions are a violation of residents rights, considered neglect of care and constitute abuse. The facility was aware of a previous substantiated allegation against AP2 for abuse and continued to employ AP2 after that knowledge. The facility's failure is a violation of resident rights, is considered neglect of care and constitutes abuse.
