Findings: The Alleged Victim (AV) was a known fall risk and had prior falls, although there were no interventions in place to monitor AV for safety. On or about March 25, 2021, staff had advised Alleged Perpetrator #2 (AP2) that AV didn't want to get up, his/her leg was swollen and was in pain when moved. AP2 assumed this was some other issue that AP2 was already aware of and did not check AV for a change of condition. AV was transported to the hospital and was diagnosed with a fractured femur. AP2's actions are a violation of resident rights, is considered neglect of care and constitutes abuse. The facility's failure to provide a safe environment and assure timely medical treatment is a violation of resident rights, is considered neglect of care and constitutes abuse.
