Findings: Alleged Victim (AV) relies on the facility for a safe environment. On or about February 09, 2021, Witness 1 (W1) started to have behavioral changes including aggressive behavior towards staff and other residents. The facility failed to adjust the service plan for W1 leading to continued aggressive behavior. On or about April 30,2021, W1 approached AV from behind and placed his/her hands around AV's throat and appeared to strangle AV resulting in red marks on AV's neck. Facility failed to provide a safe environment for AV, which is a violation of resident rights, is neglect of care and constitutes abuse as defined in OAR 411-020-0002 (1)(b)(A)(i).
