Findings: The following narrative has been updated per Settlement Agreement: The Alleged Victim (AV) was wearing a protective boot on his/her foot which was badly infected. Staff were instructed not to wake AV when sleeping to perform care. On or about July 30, 2021, Alleged Perpetrator #2 (AP2) went into the AV's room and woke him/her and jerked and twisted AV's foot back and forth until his/her boot came off so he/she could check AV's wound. AP2 left the room without replacing the bandage or the boot. AV had a similar incidents with AP2 earlier in the year and has been terrified of AP2 since that time. AV had asked numerous times for AP2 not to provide care for him/her and has refused care from AP2 multiple times. AP2's actions were investigated and abuse was unable to be determined. The facility failed to provide a safe environment, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
