Findings: Alleged Victim (AV) relies on the facility for his/her care. AV has an Interim Service Plan (ISP) dated October 05, 2021, AV is to fold laundry at a specific table in the dining room, away from high traffic. On or about October 09, 2021, Alleged Perpetrator #2 (AP2) placed laundry on a bench in the common area because AP2 was in a hurry. AV was folding the laundry at the bench when another resident touched the laundry making AV upset. Witness 1 (W1) removed the other resident and returned to talk to AV. AV began to hit W1, causing W1 to hit AV. AP2 failed to follow the care plan, which is a violation of resident rights, is considered neglect of care and constitutes abuse. The facility failed to ensure the care plan was being followed, which is a violation of Oregon Administrative Rules.
