Findings: Alleged Victim (AV) relies on the facility for his or her care and has a history of falls and behaviors. On or about April 20, 2022, AV was wanting to get up from a chair and AP2 was reportingly arguing with AV and pulling AV’s belt to get AV to sit back down. AP2 was heard telling AV they would not help AV if they fell and then AP2 walked away, resulting in AV falling onto the floor. Facility staff did not call emergency services and reported the fall as noninjury despite staff stating AV hurt his or her elbow and applied an ice pack. The facility and AP2 failed to provide services, which is a violation of resident rights, is neglect of care and constitutes abuse.
