Findings: Alleged Victim (AV) ambulates with the use of a four-wheel walker or wheelchair with staff assistance. AV is a fall risk, due to h/h falls in the past. During investigation Alleged Perpetrator 2 (AP2) and other staff were moving resident's walkers across the living room from the recliners to keep an open path for other residents to walk through with their walkers or wheelchairs. On or about August 13, 2022, AV got up from the recliner on h/h own, which is not like AV, and h/h walker was not close enough for AV to reach it and AV experienced a fall. AV sustained a skin tear on h/h right elbow/arm and was diagnosed with a fractured humerus. The allegation that AP2 failed to provide service and a safe environment to alleged victim was investigated and the determination was inconclusive. The facility failed to provide oversight, monitoring of staff necessary for a safe physical environment for AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
