Findings: Witness 1 (W1) has a known history of physical aggression towards other residents. On or about September 4, 2022, W1 kicked AV in the leg after seen AV become aggressive towards a staff member. W1 has kicked AV previously and has a history of resident-to-resident altercations. The facility failed to provide a safe environment for AV, which is a violation of resident rights, is neglect of care and constitutes abuse.
