Findings: Witness #1 (W1) is known to be aggressive and have altercations in the dining area. W1 care plan indicates “do not seat other residents at the same table with the resident” “during mealtimes W1 is to have the table to themselves so they don’t get agitated and be verbally aggressive to others”. On or about September 22, 2022, Alleged Victim (AV) and W1 were seated at the same table. W1 became agitated was verbally aggressive with staff. W1 threw a napkin, and food at AV. W1 also kicked AV under the table. The facility’s failure to follow the care plan is a violation of resident rights, is considered neglect of care and constitutes abuse.
