Findings: Witness #1 (W1) is known to hallucinate, pace constantly throughout the day, and invade other residents’ personal space. W1 service plan, staff to check with W1 if seen pacing and encourage W1 to sit down. Alleged Victim (AV) has history of hallucinations and resident-to-resident altercations. AV ISP staff to immediately redirect AV when seen hallucinating and begins to bat at the air. On or about October 08, 2022, W1 was wandering around facility, and AV seen hallucinating in common area. Camera review shows AV seen speaking to W1, leading to a resident-to-resident physical altercation, resulting in W1 choking AV and both falling to the ground. AV sent to emergency room due to pain. The facility failed to follow resident care plan which is a violation of resident’s rights is neglect of care and constitutes abuse.
