Findings: The Alleged Victim (AV) and Witness 1 (W1) have a history of verbal and physical altercations. The facility failed to follow AV’s care plans. According to an investigation, AV and W1 had a previous resident-to-resident altercation and AV was on a behavior plan for monitoring for aggression with staff and other residents. On or about October 28, 2022, AV and W1 had a resident-to-resident altercation where AV sustained a fractured hand. The facility’s failure is a violation of resident rights, is neglect of care which constitutes abuse.
