Findings: The facility failed to implement interventions and appropriately monitor Witness 1 (W1) and Alleged Victim (AV) according to their known behavior and prior resident-to-resident altercations. The failure resulted in a physical altercation on or about December 30, 2022 in which AV hit W1 unprovoked resulting in W1 then hitting AV in his/her face and pulling his/her hair. According to facility documentation and interviews, facility staff were unable to deescalate the situation and had to call Local Law Enforcement Agency for assistance. Staff were not present to monitor and/or redirect AV and W1 when incident initially happened. The facility's failure to provide a safe environment for AV and W1, caused unreasonable discomfort to both AV and W1, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
