Findings: Between November 5, 2022, through December 14, 2022, Witness 1 (W1) had six (6) behavior incidents. On or about January 6, 2023, Alleged Victim (AV) was in the family room of the facility when W1 came in and rammed into AV with his/her wheelchair pushing AV into the fireplace. W1 stated that he/she had rammed AV as payback for AV knocking his/her hat off and that AV still had three more injuries coming, W1 also stated, “I will get AV, next time I hit him/her, he/she will be dead with one punch.” The facility failed to provide a safe environment for AV by not supervising W1 appropriately, which is a violation of resident rights, is neglect of care and constitutes abuse.
Sanction: ALFCP24-00025 $375.00 fine assessed
