Findings: Alleged Victim (AV) has a history of being verbally aggressive and threatening to residents and staff and physically inappropriate and verbally inappropriate with residents. AV’s service plan list AV behaviors related to alcohol consumption. The caregiver is to encourage AV to avoid alcohol at all times. On or about February 13, 2023, AV was observed drinking beer in the gazebo on the common area on the backside of the facility. Witness 1 (W1) yelled at AV and called AV a foul name. AV in turn threw half of a full beer and hit W1 in the chest. Witness 2 (W2) was also in the back area and approached AV as they were walking toward the back door. A physical altercation ensued between AV and W2. The facility failed to provide a safe environment for both AV and W2 creating a risk of serious harm for both AV and W2, which is a violation of resident rights, is neglect of care and constitutes abuse.
