Findings: Witness 2 (W2) has a history of being verbally aggressive and threatening to residents and staff and physically inappropriate and verbally inappropriate with residents. W2’s service plan list W2 behaviors related to alcohol consumption. The caregiver is to encourage W2 to avoid alcohol at all times. On or about February 13, 2023, W2 was observed drinking beer in the gazebo on the common area on the backside of the facility. W2 yelled at Alleged Victim (AV) and called AV a foul name. AV in turn threw half of a full beer and hit W2 in the chest. (AV) was also in the back area and approached W2 as they were walking toward the back door. A physical altercation ensued between W2 and AV resulting in serious harm to AV. The facility failed to provide a safe environment, which is a violation of resident rights, is neglect of care and constitutes abuse.
