Findings: Witness #1 (W1) is known to have altercations with other residents and is care planned to be assisted by staff when going outside to smoke. On or about March 6, 2023, W1 went outside to smoke, someone was sitting in the chair that he/she likes to sit in. W1 yelled at this person and the Alleged Victim (AV) stood up to W1 to say he/she should not yell at people. W1 hit AV with a bag 3 or 4 times. Neither resident was injured, however, AV was placed at risk for harm. The facility failed to follow the care plan, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
