Findings: The Alleged Victim (AV) is on a puree diet, and staff assist AV with eating. It was noted by staff that AV wasn't swallowing his/her food, and staff had noticed that AV was coughing and/or choking during lunch. On or about May 16, 2023, AV was found to have food in his/her mouth, appeared ill and his/her oxygen levels were low. AV was sent out to the hospital, where hospital staff found AV to have a significant amount of impacted food in his/her mouth and throat. AV was diagnosed with aspiration pneumonia. The facility's failure to address AV's change in behavior is a violation of resident rights, is considered neglect of care and constitutes abuse.
