Findings: Witness 1 (W1) has a known history of resident-to-resident altercation and becoming verbally abusive. On or about April 29, 2023, Alleged Victim (AV) and W1 were involved in a resident-to-resident altercation; W1 rammed his/her wheelchair into AV’s walker in an aggressive manner; AV was encouraged to call for a staff escort if fearing fearful of W1. On or about May 15, 2023, W1 began to yell and cuss at AV as AV was exiting the elevator; W1 yelled to AV to move his/her “slow ass,” called AV a “dipshit” and a “bitch” and asked, “what the hell are you waiting for”. The facility failed to protect AV from verbal abuse from W1 by failing to implement proper interventions for W1’s increasing behavioral needs, which is a violation of resident rights, is neglect of care and constitutes abuse.
