Findings: The Alleged Victim (AV) requires staff to place TED hose on him/her in the morning and remove them in the evening. Alleged Perpetrator #2 (AP2) was assisting AV with his/her TED hose and pulled up on them, causing AV to suffer a skin tear, causing pain and unreasonable discomfort. AP2 was known to become frustrated while working with residents and need to leave the room. The facility was aware of AP2's actions and had reprimanded AP2 for behaviors towards other residents. AP2's actions towards AV are a violation of resident rights, are considered neglect of care and constitute physical abuse. The facility's failure to protect AV from physical abuse is a violation of resident rights, is considered neglect of care and constitutes abuse.
