Findings: Witness #1 (W1) is known to have behaviors and is care planned to be kept separated from the Alleged Victim (AV). On or about June 13, 2023, W1 was aggressive with staff and then wandered into the dining room. AV was in the dining room and W1 approached and grabbed an object from AV while staff watched. W1 then pushed AV using an open hand to the throat, causing AV unreasonable discomfort. The facility failed to follow the care plan, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
