Findings: The Alleged Victim (AV) and Witness 1 (W1) have history of behaviors and resident-to-resident altercations. W1 is known to become aggressive when other people are too close to him/her or are in his/her space. According to an investigation, on or about July 11, 2023, staff were alerted to a resident-to-resident between incident between AV and W1 when they heard a loud slap and observed AV holding his/her left check, which resulted in unreasonable discomfort and a loss of personal dignity. The facility failed to provide a safe environment for AV, which is a violation of resident rights, is neglect of care which constitutes abuse.
