Findings: On or about July 7, 2023, the facility failed to provide basic care and supervision resulting in a resident-to-resident altercation that caused harm to Alleged Victim (AV) when Witness 1 (W1) was being sexually inappropriate with AV. W1 has a history of inappropriate sexual behaviors. On multiple subsequent occasions, W1 was observed having sexual contact with AV. The facility did not respond to W1's repeated inappropriate sexual contact with AV. Based on facility documentation and interviews, AV was noted to have a change in behavior as a result of W1's inappropriate sexual behaviors towards AV. The facility failed to properly care plan for W1's in appropriate behaviors causing an unsafe environment for AV which is a violation of resident rights, is considered neglect of care and constitutes abuse.
