Findings: The facility failed to implement appropriate interventions and failed to appropriately monitor Witness 1 (W1) according to his/her known sexualized behavior and prior altercations. On or about August 23, 2023, W1 walked past Alleged Victim (AV) in the hallway of the facility and reached out and touched AV's breast with both hands and slid his/her hand to AV's bottom. Based on facility documentation and interviews, there were prior altercations between W1 and AV on August 7, 2023, August 12, 2023, August 18, 2023, August 19, 2023, and August 20, 2023. The failure resulted caused unreasonable discomfort to the AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
