- Findings
- On September 1, 2023, Witness 1 (W1) moved into the facility. W1 has had 5 resident-on-resident incidents since s/he moved in. W1 Behavior Plan dated September 12, 2023, indicates if staff see W1 entering other resident’s rooms they are to offer W1 to go for a walk outside or have a cup of coffee and if W1 is not redirectable staff are to try change of face and stay with h/h to prevent altercations. On September 15, 2023, Alleged victim (AV) and W1 were engaged in a physical resident-on-resident altercation; W1 hit AV in the face causing AV to fall to the ground and sustain significant injuries to the left side of AV’s head, face, and neck area. AV complained of headaches and pain, was given PRN medication, AV was sent to the hospital and continued to complain of pain for several days. The facility failed to implement proper interventions and address W1’s known aggressive behaviors towards other residents leading to a resident-on-resident incident which is a violation of resident rights, is considered neglect of care and constitutes abuse.
