Findings: Alleged Victim’s (AV’s) service plan instructs staff to maintain visual supervision of AV when AV and Witness 1 (W1) are in the same room. On or about September 25, 2023, AV and W1 sat near one another in a common area. W1 was seated in a recliner and AV was asleep in AV’s geri-chair. There was one chair between W1, and AV. Staff left the two unsupervised. Staff then heard multiple residents yell, “Stop that. Stop that.” Staff ran to the common area and observed W1 standing over AV holding AV’s slipper in one hand, and AV’s foot in the other. AV was holding his/her eye and grimacing. The facility failed to follow AV’s care plan by leaving AV unsupervised with W1, which is a violation of resident rights, is neglect of care and constitutes abuse.
