Findings: Alleged Victim (AV) relies on the facility for his/her care. On or about September 26, 2023, an altercation occurred between AV and Witness 1 (W1) while outside in the smoking area. AV reported that W1 ran into his/her legs with a wheelchair and used foul language on AV. AV and W1 are not supposed to be outside in the smoking area at the same time per administration directive. The facility failed to provide a safe environment for AV, putting AV in risk of harm, which is a violation of resident rights, is neglect of care and constitutes abuse.
