Findings: Alleged Victim (AV) relies on the facility for his/her care. AV has cognitive impairments, has difficulty understanding English, and h/h primary language is Mandarin. AV's Service Plan directs staff to use a soothing voice and be patient while trying to communicate with AV. On or about October 13, 2023, AP2 uses derogatory language such as, "Cracked in the head," "You're covered in poop, I'm not touching you." "Gross." and "AV should be in an insane asylum," . AP2 spoke in a harsh tone and yells at AV to "Get up, get up," and orders AV to "Sit down!" multiple times. AP2 was properly trained to work with residents. AP2 did not follow the Service Plan or their training protocol. As a result of the incident, AV experienced unreasonable discomfort and loss of personal dignity. AP2's actions is considered verbal/emotional abuse. The facility failed to protect AV from verbal/emotional abuse which is a violation of Oregon Administrative Rules.
