Findings: Witness 1 (W1) has history of behavioral disturbances, aggressive behaviors, and is known to approach other residents and get into their personal spaces. W1 service plan, indicates, if staff see W1 wandering the dining room the staff are to offer h/h a cup of coffee. On or about October 15, 2023, W1 approached and began to touch Alleged Victim’s (AV’s) s plate. AV and W1 then go back and forth, each striking each other on the arms and W1 striking AV on the face, resulting in scratches to AV’s face. The allegation that AP2 failed to follow care plan was investigated and the determination was not substantiated. The facility failed to properly plan care, provided interventions appropriate to mitigate W1’s known aggressive behaviors towards other residents leading to a physical resident-to-resident altercation, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
