Findings: The Alleged Victim (AV) and Witness #1 (W1) reside in the facility. AV has impaired cognition which requires AV to have support to make appropriate decisions regarding his/her health and safety. AV and W1 began spending time together in August 2023. In September 2023, Witness #4 (W4) stared to express concerns regarding AV's relationship with W1. AV and W1 were found in bed together in September and October of 2023. AV disclosed to staff that he/she was being sexually abused by W1 and felt like he/she could not get away from W1. AV felt like he/she could not say anything to W1 because AV was afraid of W1. The facility was aware of AV's cognition and inability to consent to a sexual relationship and did not put interventions in place to assure AV's safety from W1. The facility's failure to ensure AV's safety is a violation of resident rights, is considered neglect of care and constitutes abuse.
