Findings: Alleged Victim (AV) relies on the facility for his/her care. AV is care planned to have toileting and incontinence assistance. AV has episodes of resisting ADLs. If AV resists ADLs, staff is to wait 30 minutes and re-try. Use calm and direct language. On or about October 31, 2023, Alleged Perpetrator #2 (AP2) was called to Alleged Victim’s (AV) room to assist two other caregivers in changing AV's brief. AV declined twice became resistant and hit, punched AP2, then attempted to kick AP2 in the face. AP2 reacted by hitting AV. AP2 failed to follow AV's care plan and actions are a violation of resident rights, are considered neglect of care and constitute physical abuse. The facility’s failure is a violation of Oregon Administrative Rules.
