Findings: Witness 1 (W1) has a known history of sexual behaviors. On or about November 14, 2023, W1 was found touching an opposite gender resident in an inappropriate sexual manner. On or about November 22, 2023, W1 was found in the common area with his/her hand down the shirt of an opposite gender resident. When the video footage was checked, staff realized W1 did the same to Alleged Victim (AV) first. W1 moved to the side of AV who was seated near the other resident, reached over, and began touching AV’s chest. The facility failed to provide a safe environment for AV, putting AV in risk of harm, which is a violation of resident rights, is neglect of care and constitutes abuse.
