- Findings
- On December 20, 2023, ODHS Adult Protective Services (APS) conducted investigation #00302847 in response to concerns regarding the care provided to the Alleged Victim (AV) at the facility. The APS investigation report is incorporated here by reference. AV resided at the facility with a documented need for mobility assistance due to an identified fall risk. Based on facility documentation and interviews, on or about October 20, 2023, AV slid out of a recliner and reopened existing rug burns. On or about November 15, 2023, AV reported falling in the shower, which resulted in AV being placed on fall alert and receiving standby assistance due to increased neck pain, a crunching sensation, and limited range of motion. Despite these incidents and AV’s known fall risk, the facility failed to implement adequate interventions to mitigate the risk of further harm. The lack of appropriate care planning and timely response resulted in continued pain and discomfort for AV. This failure to provide appropriate services in accordance with AV’s assessed needs constitutes a violation of resident rights, is considered neglect of care, which constitutes abuse.
