- Findings
- Alleged Victim (AV) is known to get into altercations and have aggressive behaviors. AV is known to wander throughout the facility. On December 15, 2023, AV entered Witness 1 (W1’s) room thinking it was h/h room. W1 then told AV that this was h/h room and AV struck W1. W1 then struck AV. As a result of the altercation, W1 had scratches to h/h nose and AV had bruising to each cheekbone and a bleeding lip. AV has previously caused injury to other residents as a result of physical resident-to-resident altercations. Interventions in place to reduce AV’s behaviors are staff to offer to walk with AV, staff to offer AV a snack, and staff to sit with AV in h/h room to minimize distractions. There are no interventions in place to address AV’s wandering into other resident rooms. W1 is known to be upset by others coming into h/h room. Interventions in place to address W1’s known triggers include: If staff see W1 leave their door open, they are to close it to prevent other residents from wandering or looking in. The facility failed to properly plan care for AV leading to continued aggressive behavior and wandering into other resident rooms and failed to place effective interventions to manage W1’s known triggers of having other residents wander into h/h room, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
