Findings: Witness #2 (W2) has a long history of having altercations with other residents. W2 had been placed on one to one care when in the common areas of the facility due to his/her aggressive behaviors towards other residents. On or about December 21, 2023, the Alleged Victim (AV) was walking through the common area and asked W2 to move and W2 punched AV in the face. AV was sent out to the hospital for evaluation. AV did not suffer any injury, however, AV was placed at risk for serious harm. The facility's failure to follow AV's temporary service plan to ensure one to one care placed AV at risk for harm, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
