Findings: On or about December 26, 2023, staff entered the Alleged Victim's (AV) room and found AV with his/her brief undone on one side. Witness #1 (W1) has a history of aggressive behaviors towards residents and staff and is fixated on Witness #2 (W2), who is AV's room mate. AV and W1's room is to be locked at all times. On this day, the room was unlocked and staff saw W1 leaving AV and W1's room, which is when they found AV with his/her brief undone, and AV was fearful and stating "it hurts" to staff. The facility's failure to follow the care plan placed AV at risk for harm. The facility's failure is a violation of resident rights, is considered neglect of care and constitutes abuse.
