- Findings
- Alleged Victim (AV) and Witness 4 (W4) are residents and under the care of the memory care facility. AV and W4 both have an advanced progressive neurocognitive disease affecting brain function. On or about December 28, 2023, AV entered W4's room, resulting in a physical altercation that caused AV to receive skin tears to his/her arms and face. Based on facility documentation and interviews, AV requires monitoring when wandering the hallways of the facility due to AV entering other resident's rooms without permission. W4 has a known history of physical aggression towards others entering W4's room or when others are too close to W4. W4 has a known history of aggression towards other residents and has had two prior altercations with AV in which W4 was the aggressor on August 14, 2023, and on November 29, 2023. The investigation determined the facility failed to appropriately monitor AV when AV was engaging in known wandering behavior, resulting in AV wandering into W4's room and sustaining injuries from being physically injured by W4. The facility's failure to provide a safe environment is violation of resident rights, is considered neglect of care, and constitutes abuse.
