Findings: Witness 1 (W1) has a history of using items in the facility as weapons. W1’s care plan states that staff are to be alert when W1 is around other residents and be aware of items near W1 that may be used as weapons. On or about December 30, 2023, W1 and Alleged Victim (AV) were sitting in the common area with other residents. Staff heard yelling and found W1 holding a pair of scissors and threatening to “kill everyone”. The scissors that W1 used to harm AV were left in a drawer in the common area that resident can access. The scissors should have been locked in a medication cart where they are normally kept. It appears W1 had no one watching him/her while W1 was in the common area. The facility failed to follow the care plan which put AV at risk, which is a violation of resident rights, is neglect of care and constitutes abuse.
