- Findings
- Witness #1 (W1) and Alleged Victim (AV) have history of altercations with other residents. W1 behaviors can be triggered by being too close to people. AV behaviors can be triggered by others being in h/h space. AV and W1 share a room and have a history of at least one altercation between each other. Both residents are triggered by other residents being in their personal space. The facility has this documented information in AV’s care plan and W1’s care plan and chose to keep then in a shared room together. On or about December 28, 2023, an altercation took place in the shared room of AV and W1. AV was heard yelling, Witness #4 (W4) and Witness #2 entered the room and witnessed W1 hit AV in the face. Staff separated AV and W1. Redness was seen to AV's face. On or about December 29, 2023, purplish bruising was noted along AV's left eyebrow and under AV's left eye. The facility failed to properly plan care, implement person centered interventions appropriate to mitigate and address the documented aggressive behaviors between AV and W1 resulting in resident-to-resident altercation, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
