Findings: Alleged Victim (AV) relies on the facility for his/her care. Witness #1 (W1) has a history of agitation and aggression towards other residents. On or about January 25, 2024, AV and W1 were involved in a resident-to-resident altercation for the first time and separated. On January 26, 2024, AV was sat next to W1 at the same table during mealtime, which lead to a resident-to-resident altercation. W1 pulled on AV's shirt and hit AV in the face. W1 has a behavior plan with interventions in place; if staff see W1 approaching other residents in dining room they are to redirect h/h to own table and provide h/h with a snack. Additional interventions in place, staff are to redirect W1 when they see another resident in W1 personal space or too close to W1. The facility failed to follow the interventions already in place for W1 which resulted in AV, being physically struck. The failure is a violation of resident rights, is considered neglect of care and constitutes abuse.
