Findings: The facility failed to appropriately monitor Witness 1 (W1) according to his/her known behavior and prior altercations. On January 16, 2024, W1 and Alleged Victim (AV) had a resident-to-resident altercation resulting in AV falling out of his/her chair, and landing on his/her hands and knees. AV and W1 have a history of engaging in altercations with each other. Based on facility documentation and interviews, the facility failed to protect AV from the risk of physical harm. AV showed signs of being a little anxious after incident. The facility administered AV's PRN medication to help with his/her anxious symptoms. W1 had been showing signs of increased behaviors and refused his/her PRN medication the day of the incident. The facility's failed to protect AV from W1's aggressive behaviors, causing unreasonable discomfort to AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
