Findings: The facility failed to appropriately monitor Witness 1 (W1) according to his/her known inappropriate sexualized behavior. On or about February 29, 2024, W1 groped Alleged Victim's (AV) upper body without permission which caused AV emotional harm. Based on facility documentation and interviews, this was W1's first time being inappropriate with a resident; however, W1 has a known history of touching the staff's upper body and lower areas below the waist. Prior to this incident, staff were directed to monitor W1 for inappropriate behavior and redirect W1 accordingly. The facility's failure to adequately supervise W1, caused emotional harm to AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
