- Findings
- Witness 1 (W1) has a long history of resident-to-resident altercations with sixteen documented alterations reported since October 2023, and W1 is consistently refusing medications. Alleged Victim (AV) is not known to have aggressive behaviors, but has a history of trying to "help" staff by telling others what to do which has led to previous altercations with other residents. AV has an intervention in place that if staff see AV telling others what to do, staff are to thank AV for trying to help but redirecting AV. W1 and AV have a history of altercations with their last altercation on February 16, 2024. On or about March 04, 2024, AV approached W1 to tell W1 to put a dessert back which led to a resident-to-resident altercation. W1 slapped AV three times in the face and grabbed AV's shirt. Although there are interventions in place for W1, there are no additional interventions in place after altercation with AV on February 16, 2024. The facility failed to follow AV intervention and intervene when AV told W1 to put a dessert back, and the facility failed to put effective interventions in place after the last resident-to-resident altercation with AV and W1 on February 16, 2024, which caused an altercation on March 04, 2024, which is violation of resident rights, is considered neglect of care and constitutes abuse.
