Findings: Both the Alleged Victim (AV) and Witness 1 (W1) rely on the facility for care. W1 has a history of aggressive behaviors resulting in resident-to-resident altercations and the AV has a history of wandering into other resident rooms. On or about February 3, 2024, AV wandered into W1’s room where W1 pushed the AV down, causing AV to hurt their ankle and left a red mark on their head. The facility failed to implement interventions to address W1 aggressive behaviors and provide a safe environment for AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
