Findings: Both the Alleged Victim (AV) and Witness #1 (W1) rely on the facility for care and have documented cognitive impairment. According to an investigation, on January 19, 2024 and January 20, 2024, W1 was found in AVs room naked, with one of the times W1 was in AV's bed and both were naked. On or about January 26, 2024, W1 and AV were found naked in AVs bed again. Both AV and W1 appeared embarrassed that staff had walked in on them. AV became agitated when staff asked W1 to get dressed and leave AV's room. The facility failed to implement effective interventions or appropriately care plan for W1 and AV's behaviors, and failed to provide a safe environment for AV, resulting in repeated serious loss of dignity for AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
