Findings: The Alleged Victim (AV) and Witness 2 (W2) both rely on the facility for their care. W2 has a history of aggressive behaviors and physical altercations, and has previously assaulted AV. According to an investigation, on or about March 24, 2024, W2 hit AV in the chest multiple times and stepped on AV's feet resulting in physical pain for AV. The facility failed to implement interventions and/or appropriately care plan for W2's known behaviors and provide a safe environment for AV, causing unreasonable discomfort, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
