Findings: Both the Alleged Victim (AV) and Witness 1 (W1) rely on the facility for care. W1 has a history of aggressive physical behaviors resulting in resident-to-resident altercations with the AV. The AV has a history of wandering into other resident rooms. On or about February 6, 2024, staff entering W1's room found W1 grasping AV's hands and forcing AV to the floor, after pulling AV from AV's wheelchair. Then on or about February 14, 2024, AV was passing W1’s room door when W1 came out of the room and pushed AV. The facility failed to implement interventions to address W1 increasing history of aggressive behaviors and provide a safe environment for AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
