- Findings
- Alleged Victim (AV) and Witness 1 (W1) both have a history of resident-to-resident altercations and aggressive behaviors. On or about April 1, 2024 AV experienced escalating behaviors over a three-hour period. At approximately 1913 AV approached a resident in a wheelchair in the dining room and told them to get up. W1 was also present in the dining room and interjected on behalf of the resident in the wheelchair. AV walked over to W1 and attempted to strike W1, W1 blocked AV’s strike and the two hit at each other. W1 then grabbed onto AV’s arms resulting in an injury to AV’s left arm consisting of a skin tear and skin discoloration. AV service plan: If AV is getting upset and agitated staff are to offer to put a movie on in h/h room and bring h/h snacks where it is quiet. If AV begins to show agitation towards other residents as displayed by yelling, cussing, or physical aggression, staff are to redirect AV away from other residents until s/he calms down. If AV continues to escalate and be agitated, one staff member will stay with h/h while another staff member calls 911 for high level of care assist. If staff see AV in the dining room standing over other residents they are to redirect h/h to a seat. Staff is to intervene, and redirect AV away from other residents, when s/he shows signs of agitation, or aggression. Staff were not present in the dining room when AV and W1 got into an altercation, indicating that staff were not monitoring AV despite h/h escalating behaviors. The facility failed to provide a safe environment and follow AV service plan, resulting in AV’s escalating behaviors, physical harm to AV when AV was involved in a resident-to-resident altercation and sustained an injury to h/h left arm.
